These Terms & Conditions ("Terms") govern your use of the websites, online ordering, and text-message program operated by Hello Chonky Cookie Co., LLC ("Hello Chonky," "we," "us," or "our"), including hellochonky.com, shop.hellochonky.com, and gifts.hellochonky.com. By using our sites, placing an order, or joining our text messages, you agree to these Terms.

Orders & payment

• Prices, products, and availability may change without notice. We may limit or cancel orders, including for pricing errors or suspected fraud; if we cancel a paid order, we refund it.
• Payment is due at checkout and is processed by our payment provider.
• Applicable sales tax and shipping charges are shown before you pay.

Shipping, delivery & pickup

• Delivery dates are estimates. Carriers, weather, and other events outside our control can cause delays.
• Please provide an accurate address. We are not responsible for orders delayed or lost because of an incorrect address.
• Our products are perishable. If your order arrives damaged or isn't right, contact us within 3 days of delivery with your order number and photos, and we'll make it right.

Food allergens

Our products are made in facilities that handle wheat, milk, eggs, soy, peanuts, tree nuts, and other allergens. Check product ingredient information before ordering, and contact us with questions.

Text messaging (SMS) terms

• Program: Hello Chonky Texts, operated by Hello Chonky Cookie Co., LLC.
• What you'll receive: depending on what you agreed to — customer care replies, order and delivery updates, pickup notices, job application updates, and, only if you separately opted in, promotions such as deals and new flavors.
• How you opt in: by checking an unchecked text-message box on our Text Messages page, at checkout, on our contact form, or on a job application, or by texting a join keyword we advertise.
• Consent is not a condition of purchase.
• Message frequency varies. Promotional messages are typically no more than a few per month.
• Message & data rates may apply.
• To stop: reply STOP at any time. You'll receive one confirmation message and no further texts unless you opt in again (reply START).
• For help: reply HELP, or email greg@hellochonky.com.
• Carriers are not liable for delayed or undelivered messages.
• Your mobile information is handled as described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

Promotions & discount codes

Promotions and codes are subject to the terms stated with them, have no cash value, may expire, and may not be combined unless we say so.

Use of our sites

Don't misuse our sites — including submitting false information, attempting unauthorized access, or interfering with their operation. All content, logos, and trademarks on our sites belong to Hello Chonky or their owners and may not be used without permission.

Disclaimers & limitation of liability

Our sites are provided "as is." To the fullest extent permitted by law, Hello Chonky is not liable for indirect, incidental, or consequential damages, and our total liability for any claim related to an order is limited to the amount you paid for that order.

Governing law

These Terms are governed by the laws of the State of Alabama, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Alabama.

Changes

We may update these Terms. The "Last updated" date above shows when they last changed.
